Vehicle Ownership Transfer Simplified in India?

It was not too long ago when MoRTH led by honourable Road and Transport Minister Nitin Gadkari added a new rule which simplified vehicle relocation between states.

The scheme is being introduced for helping all government and private professionals as relocation have become a very common practice for both sectors. According to a survey conducted by MoRTH, it shows relocation creates a sense of unease regarding the gruesome process of re-registration of vehicles from their parent state to another.

And now MoRTH has made some new changes in the existing Central Motor Vehicles Rules, 1989. This specifies that a person must nominate someone on the registration certificate, making the transfer of the vehicle easy if the original owner dies.

The New Law!

So now, new owners will have to put in a nominee at the time of their vehicle registration. However, nominees can also be added later through an online application form. Additionally, the vehicle owner also has to will also have to submit the identity proof of the designated nominee, if added.

The notification also states” “Where the owner of a motor vehicle dies, the person nominated by the vehicle owner in the certificate of registration or the person succeeding to the possession of the vehicle, as the case may be, may for a period of three months from the death of the owner of the motor vehicle, use the vehicle as if it has been transferred to him, provided that such person has, within thirty days of the death of the owner, informed the registering authority of the occurrence of the death of the owner and of his own intention to use the vehicle,

It further added the designated nominee of the vehicle can apply to claim the vehicle within 3 months from the death of its original owner by applying submitting form 31 to the concerned authority.

However, in cases of other contingencies involving divorce or division of property, the original owner can change the nomination with an agreed SOP (Standard Operating Procedure) between both parties.

The government has started taking feedback from the general public and all stakeholders before making the new vehicle ownership transfer policy live. The proposed amendment also has an additional clause which states that ‘proof of identity of the nominee, if any’ is mandatory to enable the current owner to nominate a legal heir to the vehicle.
